1. Overview

Path of Agent ("the Service") is a desktop application and associated backend services for analyzing Path of Exile 1 builds. The Service is provided by an independent developer based in Germany ("we", "us").

By creating an account or using the application, you agree to these terms. If you do not agree, do not use the Service.

2. Account requirements

• You must provide a valid email address to create an account.
• You must verify your email before using account-linked features.
• You are responsible for keeping your login credentials secure.
• One account per person. Sharing accounts is not permitted.
• You must be at least 16 years old to use the Service.

3. Credits and payment

The Service uses a prepaid credit system. You purchase credit packs, and credits are consumed when you run build analyses or follow-up chats.

• Credit packs are purchased in EUR via Stripe.
• Credits are deducted based on actual AI usage after each analysis completes.
• Credit balances do not expire while your account remains active.
• All prices include applicable VAT where required.

4. Refund policy

Under EU consumer protection law, you have a 14-day right of withdrawal for digital purchases. However, by initiating a credit purchase and using the credits, you acknowledge that the digital content has been delivered and agree that the right of withdrawal is waived for consumed credits.

For unused credits, you may request a refund within 14 days of purchase by contacting contact@pathofagent.com. Refunds are processed via the original payment method.

5. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or extract source code from the application beyond what is permitted by applicable law
• Use automated tools to abuse the Service (bots, scrapers, request flooding)
• Circumvent credit billing, authentication, or rate limits
• Share, resell, or transfer credits or account access to others
• Use the Service for any purpose unrelated to Path of Exile build analysis

Violation of these terms may result in account suspension or termination.

6. Intellectual property

Path of Agent is proprietary software. You receive a limited, non-exclusive, non-transferable license to use the desktop application for personal, non-commercial Path of Exile build analysis.

Path of Exile is a trademark of Grinding Gear Games. Path of Agent is a third-party tool and is not affiliated with, endorsed by, or sponsored by Grinding Gear Games. All Path of Exile game content, data, and imagery belong to their respective owners.

Path of Agent uses Path of Building Community, an open-source tool licensed under the Apache License 2.0, for build calculations.

7. AI-generated content

Build analysis and recommendations are generated by AI (OpenAI). While we strive for accuracy, AI output may contain errors, outdated information, or suboptimal suggestions. The Service is a tool to assist your decision-making, not a guarantee of optimal gameplay results.

We are not responsible for in-game outcomes based on AI recommendations.

8. Service availability

The Service is provided on a best-effort basis. We do not guarantee uninterrupted availability. We may perform maintenance, updates, or modifications that temporarily affect access. We will make reasonable efforts to minimize disruption.

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice. In the event of permanent discontinuation, unused credits will be refunded.

9. Limitation of liability

To the maximum extent permitted by applicable law, our total liability for any claim related to the Service is limited to the amount you have paid in credit purchases during the 12 months preceding the claim.

We are not liable for indirect, incidental, or consequential damages, including but not limited to loss of data, lost profits, or damage to your Path of Exile account or characters.

10. Account termination

You may delete your account at any time by contacting us. We may terminate or suspend accounts that violate these terms, with notice where practical.

Upon termination, your data will be deleted in accordance with our privacy policy. Billing records are retained as required by law.

11. Governing law

These terms are governed by the laws of the Federal Republic of Germany. For consumers within the EU, mandatory consumer protection laws of your country of residence apply where they provide greater protection.

12. Changes to these terms

We may update these terms as the Service evolves. Material changes will be communicated via the website or email at least 14 days before they take effect. Continued use after changes take effect constitutes acceptance.
